Terms of delivery

Our general terms of delivery according to SWISSMEM

The terms of delivery are subject to Swiss jurisdiction.

The place of jurisdiction in all cases shall be the Freiburg Regional Court. CH-3186 Düdingen, the 6th November 2023, ComatReleco AG

Warranty and goodwill information

Conditions to receive credit note, warranty or act of goodwill

  • Warranty or goodwill services are provided exclusively to the purchaser of the goods.
  • A copy of the order confirmation or invoice must be enclosed with the returns.
  • The reason for the return must be clearly formulated (form, web form).

Regulation regarding warranty and goodwill measures for own products and merchandise

  • The warranty period on our devices is 2 years from delivery date.
  • For warranty services, ComatReleco will bear the transport costs.
  • In addition to the 2-year warranty period, ComatReleco offers a voluntary, legally non-binding 3-year grace period.
  • ComatReleco offers you replacement products at the following conditions for exceptional goodwill services:
    Goodwill share in 3 year: delivery of replacement device at 50% of the net value of the goods
    Goodwill share in 4 year: delivery of replacement device at 60% of the net value of the goods
    Goodwill share in 5 year: delivery of replacement device at 80% of the net value of the goods
    The calculation of the net value of goods is based on the order confirmation or the invoice for the corresponding articles.
  • Goodwill or any repair services which exceed the stated periods of 5 years are not excluded and are reviewed from case to case. The hourly rate to be offered amounts to CHF 150.00 (EUR 125.00) excluding material.
  • In the case of goodwill services, the transport costs are borne by the recipient.

Returns due to wrong deliveries, incorrect orders or for the purpose of stock clearance

Material returns will only be accepted in consultation with the customer. The following terms apply:

  • The customer will be indemnified in the event of incorrect deliveries from ComatReleco. The goods must be returned immediately upon delivery (grace period 6 months after delivery date).
  • Material which is older than 18 months according to the production date will not be taken back. Any return will be disposed of properly.
    • a. In the case of material returns, a flat-rate handling fee of CHF 50.00 (EUR 40.00) per return will be charged during the first 6 months from the date of delivery.
    • b. If material is taken back for the purpose of stock clearance, a lump-sum compensation of CHF 50.00 (EUR 40.00) plus 15% of the net value of the goods will be invoiced. The material will only be credited after a positive incoming inspection.
    • c. If material is taken back for the purpose of stock clearance from a Swiss wholesale dealer, a flat rate compensation of 25% of the net value of the goods will be invoiced. The material will only be credited after a positive incoming inspection.
  • Material that is not originally packed will be credited with max. 60% of the net value of the goods after a positive incoming inspection.
  • Customer-specific articles are not refundable.

These conditions are based on the General Delivery Conditions dated 1 March 2012.

Data protection

ComatReleco AG assures that personal data will be treated in accordance with the applicable Swiss data protection regulations. All personal data provided to us will only be processed and used for statistical purposes. Personal data will not be passed on to third parties unless you have given your prior consent or ComatReleco AG is obliged to disclose the personal data for legal reasons. The ComatReleco AG website contains links to other websites. We have no influence on whether their operators comply with Swiss data protection regulations.

Please note that each time you access the ComatReleco AG website and each time you retrieve a file, access data is stored in a log file.

For your convenience, ComatReleco AG transmits so-called cookies to your computer for the duration of your visit to the ComatReleco AG website. Cookies are small text files that can be used to identify your computer. For information on how to block the use of cookies, please refer to the instructions for your browser software.
